Stone Circle Farm Professional Photography Agreement

Working Farm Acknowledgment

I understand that Stone Circle Farm is an active working farm and that entering and using the property may involve ordinary and inherent risks associated with a farm environment.

These may include, but are not limited to, uneven ground, holes, mud, wet or slippery surfaces, insects, plants, farm equipment, fencing, animals, weather conditions and agricultural activities.

I agree to follow all instructions and restrictions provided by Stone Circle Farm and to use reasonable care while on the property.

Responsibility for Clients

As the photographer, I am responsible for communicating Stone Circle Farm's photography rules and property restrictions to my clients and anyone accompanying them.

I am responsible for reasonably supervising my photography activities and ensuring that my clients remain within approved photography areas.

Children must remain under the supervision of their accompanying parent, guardian or responsible adult.

Crops, Property & Animals

I understand that crops, flowers, plants, displays, equipment and other farm property may not be picked, moved, altered or damaged without permission.

I understand that horses may be photographed from a distance.

Close-up photography with horses, posing with horses, entering horse areas or interacting with horses requires advance approval from Stone Circle Farm.

Due to our animals and food safety risks NO dogs or pets of any kind are allowed on the property.

Insurance

Professional photographers using Stone Circle Farm are required to maintain commercial general liability insurance appropriate for their photography business.

A current Certificate of Insurance must be provided to Stone Circle Farm.

The Certificate of Insurance and this agreement are required once per photography season. A new Certificate of Insurance is only required during the season if the photographer's coverage changes or expires.

Assumption of Risk & Release

To the fullest extent permitted by New Jersey law, I voluntarily assume the ordinary and inherent risks associated with entering and conducting photography on a working farm.

I release and hold harmless Stone Circle Farm LLC, its owner, employees and representatives from claims arising from ordinary and inherent risks associated with my use of the property, except to the extent a claim results from gross negligence, recklessness, willful misconduct or other liability that cannot legally be waived under New Jersey law.

Photographer Responsibility & Indemnification

I am responsible for my own negligent or wrongful acts and for damages or claims arising from the negligent or wrongful acts of my employees, assistants, contractors or photography clients in connection with my photography activities at Stone Circle Farm.

To the extent permitted by New Jersey law, I agree to indemnify and hold harmless Stone Circle Farm LLC from third-party claims resulting from those acts.

This provision does not require me to indemnify Stone Circle Farm for Stone Circle Farm's own negligence or wrongful conduct.

Farm Operations, Weather & Access

I understand that Stone Circle Farm is an agricultural operation and that crops, landscapes, animals and photography locations change throughout the season.

Stone Circle Farm may restrict access to any area because of weather, field conditions, agricultural activities, animal safety or other operational or safety concerns.

I agree to follow any directions given by Stone Circle Farm while on the property.

Agreement

By signing below, I confirm that I have read and understand the Stone Circle Farm Professional Photography guidelines and Photography Location Agreement & Liability Release.

I agree that this agreement will remain in effect for photography sessions I conduct at Stone Circle Farm during the current photography season.
